European Court of Justice rules US Safe Harbour agreement invalid

The European Court of Justice has ruled that the European Commission (EC) decision on the use of the US Safe Harbour agreement for transferring personal data from the European Economic Area to the USA was invalid.

This decision will have implications for all those that regularly transfer identifiable information to companies or organisations based in the United States.

The immediate implication is that UCL cannot enter into any new agreements which involve the transfer of personal data to the United States that rely on Safe Harbour. Once further information emerges from the EC and the UK Information Commissioner's Office UCL will be required to review existing agreements to put different measures in place to safeguard the personal data.
