Terms and conditions

Online Print Service

This page (and any other documents or pages referred to in it) provides you with the terms and conditions (“Terms”) on which We provide the Online Payment System and Print Service (paid for using your Account) to you.  In using the Online Payment System and/or the Print Service (paid for using your Account), you will be agreeing to be bound by these Terms.  

These Terms do not apply to any other use of Our Print Services.

We may amend these Terms from time to time as set out in clause 8. The latest version of these terms can be found at UCL Print Account Safecom. If we make any changes to these Terms we will advertise the fact UCL Print Account. You may wish to check our website from time to time as every time you use the Print Services, the latest version of the Terms will apply to that use.

These Terms were most recently updated on 17 July 2013.

Our terms

1 Information about us

1.1 We operate the website UCL Print Account.

1.2 We are University College London (Co. No. RC000631) a company incorporated by Royal Charter in England and Wales of Gower Street, London, WC1E 6BT.

1.3 Our VAT number is GB 524 3711 68.

1.4 To contact us, please contact us by telephoning our customer service team at +44 (0) 20 7679 2000 or by e-mailing us.

2 Other useful definitions

2.1 When the following words with capital letters are used in these Terms, this is what they will mean:

2.1.1 Account: your account with Us to be credited with pre-paid credit and to be used to pay for your use of the Print Services;

2.1.2 Facilities: the printers, photocopiers and scanners located within Student Areas and which are connected to the Pre-Payment System;

2.1.3 Minimum Balance: the minimum amount of credit required to be standing to your credit in your Account to be able to use the Print Services, as set out in our price list;

2.1.4 Online Payment System: the online system used to credit your Account for pre-paid printing, copying and scanning;

2.1.5 Order: your order to credit your Account using the Online Payment System;

2.1.6 Pre-Payment System: the system used to enable payment for use of the Print Services from your Account;

2.1.7 Print Service(s): the provision of access to and use of the Facilities for printing, photocopying and scanning;

2.1.8 Student Areas: the areas of Our premises that are freely accessible by you in accordance with the permissions We have granted you but excluding areas intended only for staff and/or non-student access or use or which you are otherwise not authorised to access;

2.1.9 We/Our/Us: University College London as set out in clause 1.2 above.

2.2 When We use the words "writing" or "written" in these Terms, this will include e-mail unless We say otherwise.

3 The purpose of these Terms

3.1 These are the Terms on which We provide the Online Payment System and the Print Services. These Terms do not apply to your use of the Print Services when you do not pay using your Account.

Pre-paid credit

4 Buying pre-paid credit

4.1 Please ensure that you read these Terms carefully and check that the details on your Order are complete and accurate before you submit it. Any changes to your Order are at our discretion.  If you wish to cancel an Order, please see clause 5.

4.2 You must have registered and created an Account to use and benefit from the Online Payment System.

4.3 When you submit the Order to Us, this does not mean that We have accepted your Order. Our acceptance of the Order will take place as described in clause 4.4. If, when we receive your Order, We are unable to process it or provide you with the Print Services, We will inform you as soon as possible by email.

4.4 A contract for the fulfilment of your Order comes into existence only when We issue you with a written acceptance of your Order.  At that point we will take payment of the amount specified in the Order using the card details which you have provided. On receipt of payment we will credit your Account with the amount of pre-paid credit set out in the Order.

5 Your rights to cancel and obtain a refund

5.1 Under the Distance Selling Regulations, we must notify you that the service we provide begins as soon as we provide confirmation of your Order.  As a result, there is no 'cooling-off period' and the Order cannot be cancelled and no refund can be given.

Print Services

6 Print Services

6.1 You must have registered for and have an Account to use and benefit from the Print Services under these Terms.

6.2 Subject to clause 4.3, we will supply the Print Services to you for as long as you are registered with an Account and (subject to these Terms) have credit equivalent to the Minimum Balance in your Account or we exercise our rights in clause 7.5, 7.6, 10 or 13.

6.3 We do not make any warranty or guarantee that the Print Services will be available at all times and/or that your access and use of them will be uninterrupted.

7 Price and payment

7.1 The price for use of the Facilities as part of the Print Services will be set out in Our price list in force from time to time, which can be found at the Student print charging page and will be available within a reasonable distance of each of the Facilities.  Please note that Our prices may change at any time and you should check the latest price list before using the Print Services.

7.2 The price for the Print Services includes any applicable VAT.

7.3 Each time you use the Print Services, the appropriate price will be deducted from your Account on the basis of Our price list in force from time to time.

7.4 We shall not be under any obligation to refund any amount deducted from your Account pursuant to clause 7.3 unless, due to a mistake on Our part or as a result of a technical error, the amount deducted from your Account in accordance with clause 7.3 is greater than it should be, in which case we will refund the excess charge.

7.5 If, due to a mistake on Our part or as a result of a technical error, the amount deducted from your Account in accordance with clause 7.3 is less than it should be, we reserve the right to deduct the balance from any credit in your Account or suspend your access to or use of the Print Services until the shortfall is settled.

7.6 You must maintain the Minimum Balance in your Account, failing which we may decline to provide you with the Print Services.  In order to use the Print Services, you should ensure that the credit in your Account is in excess of the Minimum Balance at all times.

7.7 If, for any reason, the Pre-Payment System permits the balance of your Account to fall below £0 (“Deficit”):

7.7.1 the Deficit will be set-off against your next Order; and

7.7.2 We have the right to:

(a) refuse to permit you to graduate; and/or

(b) provide you with access  or tickets to your graduation ceremony; and/or

(c) apply the ‘Procedures for Dealing with Students in Debt’ in the Academic Manual;

unless and until the Deficit has been paid and cleared.

General

8 Changes to Terms

8.1 We may revise these Terms from time to time.

8.2 Every time you place an Order with Us and/or use the Print Services, the Terms in force at that time will apply to the contract between you and Us.

8.3 If We have revised these Terms under clause 8.1, We will publish the fact on Our website at UCL Print Account.  The date on which these Terms were last amended is stated at the top of this page.
9 Account security

9.1 You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer.  In the absence of fraud and to the extent permitted by applicable law you accept responsibility for all Activity on your account.  

9.2 You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password or your Account is being, or is likely to be used in an unauthorised manner.

9.3 You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided.  

9.4 You must not use your Account, the Online Payment System or the Print Services:

9.4.1 in any way that causes, or is likely to cause, the Online Payment System and/or the Print Services, or any access to them to be interrupted, damaged or impaired in any way; or

9.4.2 for fraudulent purposes; or

9.4.3 in connection with a criminal offence or other unlawful activity; or

9.4.4 to cause annoyance, inconvenience or anxiety.

9.5 We reserve the right to refuse to provide the Online Payment System and/or Print Services or to terminate your Account if you are in breach of applicable laws, these Terms or any other applicable terms and conditions, guidelines or policies.

10 Suspension

10.1 We may have to suspend the Online Payment System and/or Print Services if We have to deal with technical problems or for other reasons connected with the Facilities and/or Our business. In such cases, We will endeavour to place a notice on the ISD homepage, unless the problem is urgent or beyond Our control. You may not be able to access the Online Payment System and/or all or any of the Print Services during such periods.

10.2 You acknowledge and agree that not all printers, photocopiers and scanners on Our premises will be connected to the Pre-Payment System.

11 If there is a problem

11.1 If you experience a problem with the Online Payment System and/or the Print Services, please tell Us about it as soon as reasonably possible. We will endeavour to fix the problem as soon as reasonably practicable.

11.2 As a consumer, you have additional legal rights in relation to the Print Services if they are not carried out with reasonable skill and care, or if the materials We use are faulty or the Services are not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

12 Our liability to you

YOUR ATTENTION IS DRAWN TO THIS CLAUSE 12.

12.1 We are responsible for any loss or damage you suffer that is a foreseeable result of Our failure to comply with these Terms or our negligence, but We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is a direct consequence of our breach or negligence or if it is of a type contemplated by you and Us at the time we entered into this contract.

12.2 Subject to clauses 12.1, 12.3 and 12.4, Our total liability to you whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with any contract formed under these Terms is limited to:

12.2.1 in relation to your use of the Online Payment System and an Order, the value of the Order; or

12.2.2 in relation to your access to and use of the Print Services, the price paid by you in relation to your specific use of the Print Services under which our liability has arisen.

12.3 We only supply the Services for your own personal use in connection with your studies at University College London. You agree not to use the Print Services for any other purpose, including without limitation any commercial, business or re-sale purpose. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

12.4 We will have no liability to you for any loss arising from Our suspending or ceasing your access or use of the Print Services in accordance with these Terms.

12.5 We do not exclude or limit in any way Our liability for:

12.5.1 death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors;

12.5.2 fraud or fraudulent misrepresentation;

12.5.3 breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);

12.5.4 breach of the terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples).

13 Termination

13.1 We may cease to provide the Online Payment System and/or the Print Services to you without any liability and without the requirement to give you notice if:

13.1.1 you are in breach of these Terms and do not remedy that breach within 14 days of us giving notice in writing to you; or

13.1.2 you cease to be a student at University College London; or

13.1.3 your Account is closed due to your actions and/or inactivity; or

13.1.4 we no longer wish to provide the Facilities for use by students; or

13.1.5 we cease use of the Pre-Payment System.

13.2 We may (but shall not be obliged to) return any amounts standing to your credit in your Account if we cease to provide the Online Payment System and/or Print Services to you.

14 Events Outside Our Control

14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under these Terms that is caused by any act or event that is beyond our reasonable control (“Event Outside Our Control”).

14.2 If an Event Outside Our Control takes place that affects the performance of Our obligations under these Terms:

14.2.1 We will contact you as soon as reasonably possible to notify you; and

14.2.2 Our obligations under these Terms will be suspended and the time for performance of Our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects Our performance of Services to you, We will restart the Services as soon as reasonably possible after the Event Outside Our Control is over.

14.3 You may cancel the contract if an Event Outside Our Control takes place and you no longer wish Us to provide the Services. Please see your cancellation rights under clause 5. We will only cancel the contract if the Event Outside Our Control continues for longer than 4 weeks in accordance with Our cancellation rights in clause 5.

15 Information about us and how to contact us

15.1 If you wish to contact Us in writing, or if any clause in these Terms requires you to give Us notice in writing (for example, to cancel the contract), you can send this to Us by e-mail, by hand, or by pre-paid post to University College London at Gower Street, London, WC1E 6BT or email Payment Gateway. We will confirm receipt of this by contacting you in writing. If We have to contact you or give you notice in writing, We will do so by e-mail, by hand, or by pre-paid post to the address you provide to Us in the Order.

16 How we may use your personal information

16.1 We will use the personal information you provide to Us to:

16.1.1 provide the Print Services; and

16.1.2 process or enable a third party to process your payment for the Order.

16.2 We will not give your personal data to any other third party.

17 Other important terms

17.1 We may transfer Our rights and obligations under these Terms to another organisation, and We will always notify you in writing if this happens, but this will not affect your rights or Our obligations under these Terms.

17.2 These Terms and the Order constitute the entire agreement between us and supersede and extinguish all previous drafts, arrangements, understandings or agreements between us, whether written or oral, relating to the subject matter.

17.3 We and you acknowledge that, in entering into any contract on these Terms, we do not rely on, and shall have no remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these Terms.

17.4 Other than as set out in these Terms, no representations, warranties or conditions are given or assumed by the Us and any such representations, warranties or conditions are excluded, save to the extent that such exclusion is prohibited by law.

17.5 This contract is between you and Us. No other person shall have any rights to enforce any of its terms.

17.6 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

17.7 If We fail to insist that you perform any of your obligations under these Terms, or if We do not enforce Our rights against you, or if We delay in doing so, that will not mean that We have waived Our rights against you and will not mean that you do not have to comply with those obligations. If We do waive a default by you, We will only do so in writing, and that will not mean that We will automatically waive any later default by you.

17.8 These Terms are governed by English law. You and We both agree to submit to the non-exclusive jurisdiction of the English courts.
