Dr John Sorabji to co-chair Civil Justice Council review of third-party civil litigation funding

Dr Sorabji will co-chair the Working Group of a review into how members of the public can seek third-party funding for claims, not least those against large corporations. The terms of reference for the review were published today.

Dr John Sorabji (Associate Professor at UCL Laws and member of the Civil Justice Council) will co-chair the Working Group with Mr Justice Simon Picken. The Working Group will aim to provide an interim report by summer 2024, and a full report by summer 2025.

The terms of reference, published today (23 April), outline how the review will set out the current position of third-party funding; consider whether current arrangements deliver effective access to justice; and make recommendations for reform.

The review is conducted at the request of the Lord Chancellor, Alex Chalk. It follows the announcement of plans for new legislation which will make it easier for members of the public to secure funding from third parties for claims (the Litigation Funding Agreements (Enforceability) Bill).

The review is of particular significance against the backdrop of the Post Office Scandal, where hundreds of former sub-postmasters turned to third-party litigation funding to pursue legal action against the Post Office.
