Changes to right-to-work checks

Biometric Residence Permits (BRPs), Biometric Residence Cards (BRCs) and Frontier Worker Permits (FWPs) checks

Due to a change in the law, from 6 April 2022 all biometric card holders are only able evidence their right to work using the Home Office online service. You will no longer be able to accept physical cards for the purposes of a right to work check, even if it shows a later expiry date. They will be removed from Lists A and B of acceptable documents within the Employers' right to work checklist.

Right to work checks must be carried out in the prescribed manner before employment commences. 

To use the online service, the prospective employee must provide their date of birth and right to work share code.  You should satisfy yourself that the photograph on the online right to work check is of the individual presenting themself for work.  Retain a clear copy of the response provided by the online right to work check, in accordance with UCL’s Guide to right to work checks. 

Covid-19 adjusted checks:

The adjusted check measures have been extended until 30 September 2022 (inclusive) other than for BRPs, BRCs and FWPs.  UCL will be providing further guidance on how to undertake check after this date, in due course.

Reminder – European Economic Area (EEA) (excluding Republic of Ireland) and Swiss nationals resident in the UK by 31 December 2020

Those with settled / pre-settled status must evidence their status via the online service.  EEA (and Swiss) national passports and National ID cards alone are not acceptable evidence of right to work, unless the holder is a national of the Republic of Ireland.
