The Legal Services Board (‘LSB’) has published its new statement of policy ‘upholding professional ethical duties,’ which has been finalised following the LSB’s consultation last year. The Centre for Ethics & Law submitted a detailed response to that consultation and several of the CEL’s recommendations and comments are cited in the LSB’s consultation response.
The Centre’s response was drafted in collaboration with its academic members and advisory board. Reflecting the multidisciplinary expertise and insights of its members, the response highlighted five key themes:
- Behavioural change in a complex environment
- Role identity
- transparency
- Education and training
- The need for an overriding duty
Several of the specific submissions made by the Centre were noted by the LSB in their response, including our observations and recommendations on:
- Developing cultures that support ethical decision making and identity
- Embedding ethical training in the undergraduate curriculum
- The importance of holistic ethical education that informs professional identity
- Understanding what ‘effective’ ethics training means - including the use of real-life case studies
- Preventative systems, controls and regulatory support
