Delaney Reviews Wan’s Article in JOTWELL

GCDC Director Professor Erin Delaney has reviewed Assistant Professor Trevor Wan’s (University of Hong Kong) article, ‘Globetrotting Advocates: Foreign Barristers in Hong Kong Courts’, in JOTWELL.

JOTWELL – The Journal of Things We Like (Lots) – is an online journal dedicated to celebrating outstanding recent legal scholarship. Through short 500–1,000-word reviews, known as ‘jots’, contributors highlight work they believe is valuable and deserves a wider audience. Jots are written regularly by the journal’s Section and Contributing Editors, along with guest Jots accepted on an ad hoc basis.  Delaney is Co-Section Editor of JOTWELL’s International and Comparative Law section. 

In her review, entitled ‘Litigation in the Shadows of Empires’, Delaney highlights Wan’s thoughtful analysis of ‘the history and practice of ad hoc admissions of foreign barristers to the courts of Hong Kong’. She conveys his compelling account of how the admissions scheme, once based on a model of market control, has become increasingly politicised and linked to national security concerns. Delaney notes that Wan’s study sits within broader scholarship on foreign participation (of judges and lawyers) in legal systems and should be read by all those interested in those ‘questions of judicial cosmopolitanism, foreignness, legal transplants and borrowing that have long intrigued legal scholars’.
