About the discussion
The nature of judicial review of the CJEU in the EU’s Common Foreign and Security Policy has long been discussed, given that, as a rule, the competence of the CJEU in this field has been limited or excluded by the treaties. This lecture will explore several landmark cases and the evolving limits of the CJEU’s jurisdiction in this field. It will consider whether its practice signals an emergence of an EU political question doctrine and will touch on its comparative perspective.
