The reform of the English law of secured transactions continues to be the subject of extensive debate.  Most recent contributions to this discussion have been made by the Secured Transactions Law Reform Project and the Financial Law Committee of the City of London Law Society. From 2013, the Secured Transaction Law Reform Project has been publishing policy papers discussing possible ways to reform the law in this area (avalailable here).  In July 2016, the Financial Law Committee of the City of London Law Society published a revised version of its Secured Transactions Code together with a Commentary  (available here), and is currently working on further revisions.

The purpose of the conference will be to discuss the most recent version of the Code and to discuss two further specific issues, namely whether we should abolish the distinction between legal and equitable security interests in the new regime and whether we should reform asset finance, and if so, how.

The conference will take place at UCL on 6 November 2019 from 10am until 5.30pm. It is co-organised by Richard Calnan (Norton Rose Fulbright), Paula Moffatt (Nottingham Law School) and Magda Raczynska (UCL), and supported by Norton Rose Fulbright.

The conference will provide an opportunity for those interested in this area to discuss the provisions of the Code and to consider discussion papers on the specific issues set out above. The format will be a roundtable discussion. Anyone interested in participating in this roundtable should write to Dr Magda Raczynska at magda.raczynska@ucl.ac.uk.

The Conference will be divided into four sessions:

10:00 AM - 11.30 AM: Comments on the Code

12:00 PM - 1:00 PM: Legal/equitable distinction 

2:00 PM - 3:30 PM: Title-based financing interests 

4:00 PM - 5:30 PM: How to take the reform forward?
