In this seminar, Shane Darcy will discuss his recently published book, which explores the formative role played by international courts and judicial bodies in developing international rules applicable to situation of armed conflict. The research shows how judicial bodies have influenced the substantive rules and principles of the law of armed conflict, as well as the creation, application and enforcement of this corpus of laws. The book also considers the contemporary place of judicial bodies in the international law-making process, the challenges presented by judicial creativity and the role of customary international law in the development of humanitarian law.
Dr Shane Darcy is a lecturer at the Irish Centre for Human Rights at the National University of Ireland Galway. He teaches and researchs on international humanitarian law, international criminal law, business and human rights and transitional justice. His publications include the book Judges, Law and War: The Judicial Development of International Humanitarian Law (Cambridge University Press, 2014). He is on the Editorial Board of the Business and Human Rights Journal and the Editorial Committee of Criminal Law Forum. He runs the Business and Human Rights in Ireland blog.
