Patient data is collected under legal permissions granted to the Children's HIV and AIDS Reporting System (CHARS) under Regulation 3 of The Health Service (Control of Patient Information) Regulations 2002.
CHARS has permission from Parliament to collect this data without the need to seek consent from individual patients. The service also conforms to the requirements of the Data Protection Act (2018). NHSE uses UK GDPR Article 6.1 (e) and 9.2 (h) as the legal basis for the use of data for secondary purposes.
Research Governance
Any requests for research will require approval through the Confidentiality Advisory Group and Section 251 to be undertaken by the applicant.
